We are honored to represent the Estate of Carolyn K Jones in the sale of the small line of equipment.

**AUCTION PROCEDURE**  

To participate in the auction, please register online to receive a bidding number (existing users must log into their accounts). Buyers are encouraged to reach out to Sellers for item inspections and to gather additional details or disclosures before the auction begins. The highest bidders are required to settle any outstanding invoices within 48 hours of the auction's conclusion. We reserve the right to revoke any bidding number at any time, including during the auction. Items can be removed from the auction site or Seller’s premises only upon presentation of a fully paid invoice.

 

**BIDDING AND BUYING**  

By placing a bid or making an offer in good faith, you enter into a binding agreement to complete the transaction in accordance with the specified terms if you hold the winning bid or accepted offer.

 

**SPECIAL TERMS OF SALE**  

Certain auctions or items may include terms beyond these Terms and Conditions, which may be published online or announced. These special terms can affect payment timelines, buyer's premiums, transaction fees, title fees, deposits, prepayment requirements, and deadlines for item removal. Any announced special terms are enforceable and may supersede existing provisions of our Terms and Conditions. They do not void or affect the enforceability of this agreement.

 

**AUCTION FORMAT**  

We conduct auctions in various formats, such as absolute, with reserves, multi-parcel, and private treaty. It is your responsibility to review the specific auction format before bidding. Bidding on behalf of Sellers or buybacks is prohibited. Engaging in shill bidding is a violation of the Uniform Commercial Code (UCC) section 2-238 and our policies.

 

**WARRANTIES – ITEMS SOLD WITHOUT WARRANTIES**  

To the fullest extent allowed by law, all items sold through MOP BRE are provided without any warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. Items are sold on an "as-is, where-is" basis. All descriptions provided are for guidance only and not guarantees.

 

**NO OPERATIONAL ASSESSMENT PROVIDED**  

MOP BRE does not conduct operational assessments on auction items. For vehicles or equipment, we only report the hours and miles displayed on the meter at the time of listing and do not guarantee their accuracy.

 

**MOP BRE NOT RESPONSIBLE FOR SELLER STATEMENTS**  

We are not liable for statements made by Sellers, whether verbal or written. You should validate these statements by inspecting the item before bidding. Failure to inspect is not grounds for dispute. It is your responsibility to conduct due diligence prior to bidding, as bids cannot be retracted, and there are no refunds.

 

**BUYER RESPONSIBILITY TO INSPECT**  

You must inspect items before bidding to determine their operational condition and suitability. Seller contact information and item locations are provided for your convenience. MOP BRE is not responsible for your inspections. Failing to contact Sellers for inspections does not serve as grounds for dispute or refund requests.

 

**FAILURE TO INSPECT**  

Not inspecting items prior to bidding does not justify disputing payment or refusing to take possession.

 

**SETTLEMENT / PAYMENT**  

Successful bidders must make full payment within 48 hours after the auction ends. This includes the total invoice amount, buyer's premiums, transaction fees, title fees, and applicable sales taxes. Winning bidders will receive an email with invoice instructions. Payments can be made via check (bank verified), wire transfer, ACH payment, or credit card (with a 4% convenience fee). 

 

**INTERNATIONAL BUYERS AND PAYMENTS**  

International buyers must pay additional fees for bank wires and ACH payments. Payments must be made in U.S. currency and from U.S. accounts. Proof of identity may be required, and invoice changes post-auction are not allowed.

 

**SALES TAX**  

Buyers are responsible for applicable sales tax on purchases. Exemption forms must be submitted to appropriate officials within buyer’s jurisdiction. Any sales tax assessed will be at buyers sole expense. 

 

**LICENSES**  

Buyers are responsible for obtaining necessary government-issued licenses and inspection certificates.

 

**FAILURE TO PAY/DEFAULT**  

Defaulting on payment may result in collection actions, and failure to pay will lead to account suspension from future auctions.

 

**CERTIFICATE OF TITLE INFORMATION**  

MOP BRE acts as your agent for title delivery. Title processing fees apply, and titles will be sent after full payment is received.

 

**EQUIPMENT REMOVAL**  

Purchased items must be removed within 14 calendar days. Buyers are responsible for transportation costs. Failure to remove items may incur storage fees.

 

**RISK OF LOSS**  

Buyers assume full responsibility for items after 14 days from the winning bid or upon pickup.

 

**ABANDONMENTS**  

Items not removed within 30 days are considered abandoned. Sellers may dispose of items valued at $500 or less without compensation to the buyer.

 

**COLLAPSED SALE**  

MOP BRE reserves the right to collapse any sale and return funds as necessary.

 

**SHILL BIDDING**  

Engaging in shill bidding is prohibited and may result in suspension and penalties.

 

**ACCESS TO MOP BRE WEBSITES**  

MOP BRE cannot guarantee uninterrupted access to our website and is not liable for service interruptions.

 

**INFORMATION AUTHENTICATION**  

MOP BRE reserves the right to verify account information for compliance. 

 

**INDEMNITY**  

Buyers agree to indemnify MOP BRE against any claims arising from their use of our services.

 

**JURISDICTION**  

Legal disputes must be resolved in the courts of Iowa.

 

**SEVERABILITY**  

If any provision is found to be illegal or unenforceable, the remaining provisions will continue to be valid.
